Terms of Service

These Terms of Service (“Terms”) govern your use of decorfurniture.ca and purchases made from Decor Furniture & Mattress (“Decor Furniture,” “we,” “us,” or “our”).

By using our website, placing an order, or purchasing from us, you agree to these Terms and to the policies referenced below. Please review them before completing a purchase.

Nothing in these Terms limits any rights or remedies that cannot legally be limited under applicable consumer-protection or other laws.

2. Eligibility and website use

You must have reached the age of majority in your province or territory to make a purchase through our website, or you must be acting with the authorization of a parent or legal guardian.

You agree not to use our website:

  • For an unlawful, fraudulent, abusive, or misleading purpose.
  • To interfere with the website’s operation or security.
  • To introduce malicious code or attempt unauthorized access.
  • To copy, scrape, reproduce, or commercially exploit website content without permission.
  • To submit false payment, identity, delivery, or order information.

We may restrict or terminate access to the website where reasonably necessary to prevent fraud, misuse, security threats, or unlawful activity.

3. Product information

We make reasonable efforts to ensure that product descriptions, photographs, dimensions, prices, features, materials, colours, and availability are accurate.

However:

  • Screen settings, lighting, photography, and manufacturing variations may affect how colours and finishes appear.
  • Wood, stone-look materials, fabrics, leather, marble, and other materials may have natural or manufactured variations.
  • Measurements may be approximate.
  • Manufacturers may make minor changes to specifications, packaging, construction, or finishes.
  • Accessories, décor, mattresses, box springs, or other items shown in a photograph are not included unless specifically stated.

Customers should review product descriptions and measurements carefully and contact us before ordering if a particular colour, measurement, feature, configuration, or compatibility requirement is essential.

If we discover a material error affecting an order, we will contact you and provide reasonable options, which may include confirming corrected information, selecting an alternative, or cancelling the affected item for a refund.

4. Prices, promotions, and taxes

Unless otherwise stated:

  • Prices are displayed in Canadian dollars.
  • Applicable taxes and delivery charges are added during checkout.
  • Prices may change without notice before an order is placed.
  • Promotions may have separate conditions, exclusions, start dates, and end dates.
  • Discounts cannot be combined unless specifically stated.
  • A product offered at a sale price is not automatically a final-sale item.

If an obvious pricing or promotional error occurs, we may decline or cancel the affected order before delivery. If payment has already been collected, the affected amount will be refunded. Where practical, we may offer the customer the opportunity to purchase at the correct price.

5. Payments and financing

Orders must be paid using an accepted payment method. You confirm that you are authorized to use the payment method provided and that the information submitted is complete and accurate.

Payment authorization does not guarantee product availability or final order acceptance.

Financing services may be offered by independent financing providers. Financing applications, approvals, interest, repayment obligations, and account decisions are governed by the financing provider’s terms and privacy practices. Decor Furniture does not guarantee financing approval.

6. Orders and acceptance

An order confirmation means that we have received your order. It does not necessarily mean that product availability, payment, fraud screening, delivery eligibility, or acceptance has been finalized.

Orders are subject to:

  • Successful payment authorization.
  • Product availability.
  • Fraud and security screening.
  • Correct pricing and product information.
  • Delivery-area and access requirements.
  • Any applicable quantity or purchase restrictions.

We may contact you to verify an order or request additional information.

If an ordered product becomes unavailable, significantly delayed, or cannot be supplied as described, we will contact you. Depending on the circumstances, you may choose to wait, approve an alternative, remove the affected item, or cancel the affected item for a refund.

We will not substitute a materially different product without your agreement.

7. Order changes and cancellations

Requests to change or cancel an order should be submitted as soon as possible by calling 905-388-6886 or emailing info@decorfurniture.ca with the order number.

Eligible standard orders may generally be cancelled within 48 hours of purchase without a cancellation fee, unless the order has already:

  • Been delivered or shipped.
  • Entered custom or special-order production.
  • Been specially ordered, altered, assembled, or prepared for the customer.
  • Incurred a supplier, freight, processing, or other charge that cannot reasonably be recovered.

After 48 hours, an approved cancellation may be subject to a 15% cancellation or restocking fee, plus any actual non-recoverable supplier, freight, processing, or special-order costs.

Submitting a cancellation request does not mean the cancellation has been approved. We will confirm whether the order can be cancelled and disclose applicable charges before completing an approved cancellation.

Nothing in this section limits cancellation or refund rights that apply under law.

8. Delivery and pickup

Delivery and pickup are governed by our Shipping Policy, which forms part of these Terms.

Delivery dates and timeframes are estimates unless we expressly agree otherwise in writing. Availability, weather, traffic, supplier delays, freight-carrier delays, building access, and other circumstances may affect delivery timing.

The customer is responsible for:

  • Providing a complete and accurate address and contact information.
  • Ensuring that an adult is available when required.
  • Confirming that the product will fit through entrances, hallways, stairways, elevators, and its intended location.
  • Obtaining any required elevator reservations, building permissions, parking access, or delivery approvals.
  • Preparing a safe and reasonably accessible delivery path.

Delivery, assembly, installation, packaging removal, old-furniture removal, and mattress removal are separate services unless expressly included in the order.

Additional charges may apply when a delivery cannot be completed because of incorrect information, missed appointments, unsafe access, inadequate clearance, unavailable elevators, building restrictions, or other circumstances within the customer’s control. Any applicable charge will reflect the additional delivery, storage, handling, or redelivery cost reasonably incurred.

Ownership and risk relating to a product transfer as provided by applicable law and the agreed delivery or pickup arrangement. This does not remove our responsibility for loss or damage caused by us or our delivery providers before completion of delivery.

9. Inspecting your order

Please inspect products as soon as reasonably possible after delivery or pickup.

Visible damage, missing pieces, or an incorrect product should preferably be reported within 48 hours, along with:

  • The order number.
  • A description of the concern.
  • Clear photographs of the product, packaging, shipping label, and damage where applicable.

Reporting within 48 hours helps us investigate transportation damage promptly. Failure to report within that preferred period does not eliminate rights relating to concealed defects, warranty coverage, or remedies available under applicable law.

Do not assemble, modify, discard, or continue using a visibly damaged or incorrect product before contacting us if doing so could make the problem worse or prevent proper inspection.

10. Returns and exchanges

Our Refund Policy forms part of these Terms and contains the complete return requirements.

Unless an exception in the Refund Policy or applicable law applies, eligible standard furniture may be considered for return when:

  • Authorization is requested within 7 calendar days after delivery or pickup.
  • The product is unused, unassembled, undamaged, and in resalable condition.
  • The product remains in its complete original packaging.
  • Proof of purchase is provided.
  • The return is approved before the product is transported or brought to the store.

Approved change-of-mind returns are subject to a 15% restocking fee, and the customer is responsible for return transportation.

Original delivery, assembly, installation, removal, and completed service charges are non-refundable on change-of-mind returns.

Unauthorized returns may be refused. Customers should not send or bring products back before receiving return instructions.

11. Mattresses, bedding, and hygiene-sensitive products

For health and hygiene reasons, opened or used mattresses, mattress protectors, pillows, bedding, and other sleep-contact products are final sale once their protective packaging has been opened, except where:

  • The wrong product was supplied.
  • The product arrived damaged.
  • A defect is confirmed.
  • A manufacturer comfort or exchange program expressly applies.
  • A remedy is required by applicable law.

An unopened and otherwise eligible product may be considered under our Refund Policy.

A manufacturer comfort program, when available, is governed by that manufacturer’s requirements and may require the use of an approved mattress protector, a minimum adjustment period, payment of transportation costs, or other conditions. A comfort preference is not the same as a manufacturing defect.

12. Final-sale and non-returnable items

The following are generally not eligible for change-of-mind return or cancellation after processing:

  • Opened or used mattresses and hygiene-sensitive bedding products.
  • Custom, special-order, made-to-order, modified, or personalized products.
  • Clearance, floor-model, or final-sale products clearly identified as such before purchase.
  • Assembled, installed, used, altered, stained, damaged, or incomplete products.
  • Products without their complete original packaging where packaging is required for safe return.
  • Gift cards.
  • Completed delivery, assembly, installation, removal, or other service charges.

A discounted or sale-priced product is not final sale unless it is specifically identified as final sale or falls within another non-returnable category.

Final-sale wording does not remove remedies for an incorrect, damaged, misrepresented, or defective product where a remedy is required by law.

13. Return transportation responsibility

For an approved change-of-mind return, the customer is responsible for arranging and paying for safe return transportation.

When Decor Furniture confirms that we supplied the wrong product or that a product arrived damaged or has a qualifying defect, we will be responsible for reasonable return, repair, replacement, or pickup transportation as appropriate.

Customers must follow the provided transportation and packaging instructions. We are not responsible for additional damage caused by inadequate packaging, unauthorized transportation, customer handling, misuse, or continued use after damage becomes apparent.

14. Refunds

Approved refunds are normally issued to the original payment method after the returned product has been received and inspected.

Processing times may vary depending on the payment provider, financial institution, or financing company.

Any disclosed and properly applicable restocking, cancellation, return-transportation, non-recoverable supplier, freight, or service charges may be deducted from the refund.

If the original payment method is unavailable, we will determine an appropriate lawful refund method.

15. Product warranties

Products may include a manufacturer’s limited warranty. Warranty length, coverage, exclusions, and available remedies are determined by the manufacturer’s written warranty.

We will reasonably assist customers with valid manufacturer warranty claims. Customers may be asked to provide:

  • Proof of purchase.
  • Photographs or video.
  • Product labels, model numbers, or serial numbers.
  • A description of the issue.
  • Access for inspection where reasonably required.
  • Confirmation that applicable care, support, or foundation requirements were followed.

Manufacturer warranties commonly exclude normal wear, comfort preference, accidental damage, stains, misuse, commercial use, improper assembly, unauthorized repair, inadequate support, moving damage, and damage caused by pets, moisture, or environmental conditions.

A manufacturer may choose repair, replacement parts, replacement, or another remedy permitted by its warranty and applicable law.

Nothing in a manufacturer’s warranty or these Terms limits legal rights or remedies that cannot lawfully be excluded.

16. Customer measurements and product suitability

Before ordering, the customer is responsible for confirming:

  • Product dimensions and configuration.
  • Room measurements.
  • Doorway, hallway, staircase, elevator, and ceiling clearance.
  • Building and condominium delivery restrictions.
  • Mattress, bed-frame, foundation, and accessory compatibility.
  • Floor loading or installation requirements where relevant.

We are happy to provide available measurements and general information, but customers remain responsible for determining whether a product is suitable for their space unless we expressly agree in writing to provide professional measuring or design services.

A product that cannot fit into the customer’s premises is treated as a change-of-mind or customer-access issue unless the incorrect dimensions were materially represented by us.

17. Care, assembly, and use

Products must be assembled, installed, supported, maintained, and used according to manufacturer instructions.

Decor Furniture is not responsible for damage caused by:

  • Incorrect or unauthorized assembly.
  • Misuse, abuse, neglect, or accidents.
  • Failure to use required supports or foundations.
  • Improper cleaning or chemical treatments.
  • Unauthorized alterations or repairs.
  • Moving or transporting a product after delivery.
  • Use inconsistent with the product’s intended residential purpose.

This section does not apply where the damage was caused by Decor Furniture, our authorized service provider, or a defect for which we are legally responsible.

18. Third-party services and links

Our website may include links to or integrations with third-party services, including Shopify, payment processors, financing providers, analytics services, social-media platforms, maps, and delivery providers.

Those services may have their own terms and privacy policies. We are not responsible for a third party’s independent services, decisions, content, availability, or conduct, except to the extent responsibility cannot legally be excluded.

19. Privacy

Our collection, use, disclosure, retention, and protection of personal information are described in our Privacy Policy.

Shopify also processes customer information in connection with its commerce and checkout services under Shopify’s applicable privacy terms.

20. Intellectual property

The website and its content—including our business name, branding, layout, text, graphics, photographs, videos, and design elements—are owned by or licensed to Decor Furniture or their respective rights holders.

You may use the website for personal shopping and information purposes. You may not reproduce, distribute, modify, sell, publish, or commercially exploit protected content without prior written permission.

21. Website availability and information

We aim to keep the website available and accurate, but we do not guarantee uninterrupted or error-free access.

We may correct errors, perform maintenance, update information, modify features, or temporarily suspend website access where reasonably necessary.

To the extent permitted by law, we are not responsible for losses caused solely by temporary website interruption, third-party network failure, malicious activity beyond our reasonable control, or reliance on an obvious typographical error.

22. Limitation of liability

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence, personal injury caused by negligence, breach of non-waivable legal obligations, or any liability that cannot legally be excluded or limited.

To the extent permitted by law, Decor Furniture is not responsible for indirect, incidental, special, or consequential loss that was not reasonably foreseeable when the order was placed and that results from:

  • Customer misuse, neglect, unauthorized modification, or improper assembly.
  • Inaccurate measurements or inadequate access supplied by the customer.
  • Independent third-party services outside our reasonable control.
  • Events outside our reasonable control.
  • Use of a product contrary to its instructions or intended purpose.

Where liability may lawfully be limited, our aggregate liability arising from an affected product or service will not exceed the amount paid for that affected product or service.

This section does not restrict any refund, repair, replacement, delivery, warranty, or consumer-protection remedy that must be provided under applicable law.

23. Events outside reasonable control

We are not responsible for delay or failure caused by circumstances outside our reasonable control, including severe weather, natural disasters, fire, labour disruption, government action, transportation interruption, supplier disruption, public emergency, utility failure, or widespread network failure.

If such an event materially affects an order, we will communicate with the customer and take reasonable steps to reduce the disruption. Available remedies will depend on the circumstances, these Terms, and applicable law.

24. Responsibility for unlawful website misuse

You are responsible for losses reasonably incurred by Decor Furniture as a direct result of your fraudulent or unlawful use of the website, deliberate security interference, infringement of third-party intellectual-property rights, or material breach of these Terms.

This section does not apply to ordinary customer complaints, good-faith disputes, negative reviews, requests for legal remedies, or the lawful exercise of consumer rights.

25. Governing law

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario, without limiting any mandatory consumer rights that apply based on the customer’s location.

Disputes may be brought before a court or tribunal having lawful jurisdiction. Nothing in these Terms prevents a customer from contacting a consumer-protection authority or pursuing another remedy available under law.

26. Changes to these Terms

We may update these Terms to reflect changes to our business, services, policies, technology, or legal obligations.

Updated Terms will be posted with a revised effective date. Changes will apply prospectively and will not retroactively remove rights attached to an order already accepted, unless permitted or required by law.

27. Severability and waiver

If any part of these Terms is found unenforceable, the remaining provisions will continue to apply to the extent legally permitted.

A delay or failure to enforce a provision does not permanently waive the right to enforce it later.

28. Entire agreement and policy priority

These Terms, together with the order confirmation and the Refund, Shipping, and Privacy Policies, form the agreement relating to an online purchase.

If there is a conflict:

  1. Mandatory applicable law will control.
  2. A written term specifically agreed for the individual order will control.
  3. The order confirmation will control for the product, price, and service purchased.
  4. The Refund or Shipping Policy will control for matters specifically addressed by that policy.
  5. These Terms will apply to all remaining matters.
